Resumen : | El presente trabajo de investigación expone una de las principales problemáticas
sobre el uso desproporcional de la aplicación de la medida coercitiva personal de
la prisión preventiva en el Perú, denominado: “EL DICTADO DE LA PRISIÓN
PREVENTIVA Y LA VULNERACIÓN DEL DERECHO AL DEBIDO PROCESO”;
temática que se viene discutiendo arduamente en la doctrina y jurisprudencia
nacional como hemos referido sobre este tipo de medida coercitiva personal, su
naturaleza jurídica, antecedentes normativos, entre otros. Su objetivo fue
determinar de qué manera el uso excesivo de la medida de prisión preventiva afecta
el derecho a la libertad en el Perú en el período 2019.
Asimismo, la metodología empleada es del método científico que implicará la
observación y descripción de la figura jurídica sobre la prisión preventiva, sin influir
en dicha figura bajo ninguna circunstancia; también, el diseño de investigación es
el no experimental debido a la no manipulación de variables; tomando como
principal muestra a especialistas en derecho penal.
Por otro lado, se exponen los principales resultados de la importancia del análisis
de la figura jurídica antes referida, para establecer conclusiones idóneas sobre la
importante necesidad de su estudio y sus consecuencias legales en nuestro país,
sosteniendo finalmente, que el uso desmedido y/o desproporcional de la medida
coercitiva personal de la prisión preventiva afecta vulnerando el derecho
constitucional de la libertad personal de los procesados recluidos en los centros
penitenciarios en el Perú. The present research work exposes one of the main problems about the disproportionate use of the application of the personal coercive measure of preventive detention in Peru, called: ""THE DICTATING OF PREVENTIVE PRISON AND THE VIOLATION OF THE RIGHT TO DUE PROCESS""; subject that has been discussed arduously in the doctrine and national jurisprudence as we have referred about this type of personal coercive measure, its legal nature, normative background, among others. Likewise, the methodology used is of the scientific method that will imply the observation and description of the legal figure on preventive detention, without influencing this figure under any circumstance; also, our research design is non experimental due to the non-manipulation of variables; taking as main sample specialists in criminal law. On the other hand, we will expose the main results of the importance of the analysis of the aforementioned legal figure, to establish suitable conclusions about the important need of its study and its legal consequences in our country, sustaining finally, that the disproportionate and/or disproportionate use of the personal coercive measure of preventive detention affects violating the constitutional right of personal freedom of the defendants held in the penitentiary centers in Peru. |
