La regulación jurídica de la desheredación en las uniones de hecho

Abstract

La presente investigación abarca la problemática observada con relación a la falta de regulación de la “desheredación entre los integrantes de las uniones de hecho”, habiendo sido estudiada y analizada desde perspectivas doctrinales, así como también contando con opiniones de especialistas en el tema la materia en investigación, obteniendo como resultado que por proporcionalidad es viable dicha regulación para quienes conformando uniones de hechos, así como se les ha reconocido derechos sucesorios también se regule las causales a través de las cuales vía testamento puedan ser privados de su legítima, dada su condición de herederos forzosos legalmente reconocidos, para ello se propone modificación al Código Civil incorporándose el artículo 746 - A, en claro ejercicio del ejercicio de la autonomía de la voluntad y el reconocimiento de derechos sucesorios a sus miembros, presentando previamente enunciado el problema: ¿Qué fundamentos jurídicos sustentaría la regulación de la desheredación en las Uniones de Hecho?. Es de precisar que, en la ejecución y realización de la presente investigación, empleamos el método científico, métodos generales o lógicos, y métodos específicos o jurídicos, conjuntamente con técnicas e instrumentos como recopilación documental y entrevista a diferentes especialistas en la materia de investigación. Como consecuencia del desarrollo de la investigación, obtuvimos resultados, los mismos que fueron discutidos, afirmando la posición de que los fundamentos jurídicos que sustentaría la regulación de la desheredación en las uniones de hecho son: la autonomía de la voluntad y el reconocimiento de derechos sucesorios a sus miembros. Finalizada la investigación, se ha procedido a presentar conclusiones, considerando también, como operadores del Derecho, proponer modificaciones legislativas a fin de contribuir con el mejoramiento de la legislación sucesoria, relacionada con los integrantes de las uniones de hecho.

This research covers the problem observed in relation to the lack of regulation of ""disinfection among the members of the de facto unions"", having been studied and analyzed from doctrinal perspectives, as well as counting on the opinions of specialists in the subject of research, obtaining as a result that by proportionality this regulation is feasible for those who form unions of facts, as well as have been granted inheritance rights, the through which by way of will they may be deprived of their legitimate, given their status as legally recognized forced heirs, for this purpose it is proposed to amend the Civil Code by incorporating Article 746 - A, in clear exercise of the exercise of the autonomy of the will and the recognition of inheritance rights to its members, presenting previously the problem: What legal foundations would support the regulation of disinheritance. It should be noted that, in the execution and conduct of this research, we use the scientific method, general or logical methods, and specific or legal methods, together with techniques and instruments such as documentary compilation and interview different specialists in the field of research. As a result of the development of the research, we obtained results, which were discussed, affirming the position that the legal basis that would underpin the regulation of disinfection in the unions of fact are: the autonomy of the recognition of inheritance rights to its members. After the investigation, conclusions have also been presented, considering, as operators of the law, to propose legislative amendments in order to contribute to the improvement of the successor legislation, related to the members of the the unions indeed.
