Tipificación del acoso sexual en sistema penal peruano

Abstract

El acoso sexual supone la vulneración de varios derechos fundamentales: el derecho a la libertad sexual, a la dignidad, a la intimidad, y, por supuesto a la no discriminación por razón de sexo y a la salud y la seguridad. En la primera parte se consignan la realidad del problema que origina este fenómeno conllevando a la formulación del problema donde se va plantear la hipótesis junto con sus variables y objetivos de la misma. Posteriormente se tratan las principales temáticas relativas al tema de análisis, donde se recopilo diversa bibliografía. Luego, se detalla la metodología que se usó. Finalmente, se exponen las conclusiones y propuesta legislativa de incorporar al Código Penal este tipo de delito que transgrede a derechos fundamentales.

Sexual harassment involves the violation of several fundamental rights: the right to sexual freedom, dignity, privacy, and of course to nondiscrimination on grounds of sex and health and safety. In the first part of the reality of the problem that causes this phenomenon leading to the formulation of the problem where it will hypothesize with variable work and objectives of it are reported. Subsequently the main topics on the subject of analysis, where diverse bibliography was compiled untreated. Then, the methodology used is detailed. Finally, conclusions and legislative proposal to incorporate the Penal Code such offense violates fundamental rights are set.
